E-SIGN CONSENT

Please read this E-Sign Consent carefully, and print or otherwise retain a copy for your records.

1. Introduction

In order to provide you with offers from third-party lenders, brokers, platforms, and other service providers we work with (“Partners”), and to process the credit-informed matching feature described in our Credit Authorization Agreement, we and our Partners must obtain your consent to use and rely on electronic signatures, records, and disclosures (“E-Consent”). This E-Sign Consent explains your rights when receiving disclosures, notices, and information electronically. By checking a box referencing this E-Sign Consent, or by clicking a button or link that references it – including by clicking “Agree and Find My Rates” – you acknowledge that you received this E-Sign Consent, and you consent to conduct transactions with us and our Partners using electronic signatures, electronic disclosures, electronic records, and electronic contract documents (collectively, “Disclosures”), including our Credit Authorization Agreement.

2. Option for Paper or Non-Electronic Records

You may request to receive Disclosures in paper form by contacting us at support@spotower.com, or by contacting the relevant Partner directly. We or a Partner may charge a reasonable fee for paper copies, or may provide them free of charge at our or their discretion. We and our Partners will retain Disclosures for as long as required by applicable law.

This E-Sign Consent applies to all online interactions between you, us, and our Partners, including interactions made using a mobile device, tablet, or computer. By providing this E-Sign Consent, you agree that we and our Partners may process your information and interact with you electronically for all such interactions, including the credit-informed matching feature described in our Credit Authorization Agreement. We and our Partners may send you notices related to these interactions electronically, including through a Partner’s website or by email.

4. Consenting to Do Business Electronically

Before deciding to do business with us or our Partners electronically, you should confirm that you have the hardware and software capabilities described below.

5. Hardware and Software Requirements

To access and retain Disclosures electronically, you will need: a device capable of accessing the internet; an email account you are able to access; and an internet browser that supports 128-bit encryption (such as Chrome, Firefox, Safari, or Edge). To view some Disclosures, you may also need software capable of reading PDF files (such as Adobe Acrobat Reader). To retain copies of Disclosures for future reference, you will need a device with sufficient storage space or a printer. You cannot withdraw this E-Sign Consent with respect to a Match Request you have already submitted through the Site, a Partner’s consideration of that Match Request, or a credit-informed matching request you have already authorized under our Credit Authorization Agreement, because each of these is a completed, one-time transaction at the time it occurs. If you later receive an offer from a Partner and want to withdraw your E-Sign Consent for future interactions with that Partner, you may do so at any time and at no cost by contacting the Partner directly, or by contacting us at support@spotower.com. If you withdraw this E-Sign Consent before completing a transaction with a lending Partner, you may be unable to obtain that product or service from the Partner. Withdrawing this E-Sign Consent does not affect the legal validity or enforceability of Disclosures made electronically before your withdrawal.

7. Changes to Your Contact Information

Please keep us and any relevant Partner informed of changes to your contact information, such as your email address or mailing address. You may update your information by contacting the Partner directly, or by emailing us at support@spotower.com.

8. Your Ability to Access Disclosures

BY CHECKING A BOX REFERENCING THIS E-SIGN CONSENT, OR BY CLICKING A BUTTON OR LINK REFERENCING IT, YOU CONFIRM THAT YOU CAN ACCESS DISCLOSURES IN THE FORMATS DESCRIBED IN SECTION 5 ABOVE.

BY CHECKING A BOX REFERENCING THIS E-SIGN CONSENT, OR BY CLICKING A BUTTON OR LINK REFERENCING IT – INCLUDING BY CLICKING “AGREE AND FIND MY RATES” – YOU CONSENT TO THESE TERMS AND TO DOING BUSINESS WITH US AND OUR PARTNERS ELECTRONICALLY. YOU ACKNOWLEDGE THAT YOU HAVE READ THIS E-SIGN CONSENT IN FULL.
